Probate
Probate is the process of administration of a decedent's estate through the court system. Whether or not an administrator of the estate is required will be determined by those alternatives which may be available. Often times administration is not required. For example, if the decedent has a fully funded living trust, administration is generally not required. If property is passing to a surviving spouse by a will or intestacy, the surviving spouse does not have to administer the property passing to him or her. However in certain circumstances administration may be the appropriate way to handle the estate.

As with all employment relationships, disputes may arise between brokers and their firms, particularly when the broker leaves for another firm. Most commonly, firms and their departing brokers get sideways over repayment of forgivable promissory notes, or unpaid commissions, or failure to honor promises made when the broker was recruited.
